What is Chapter 13 Bankruptcy?

Chapter 13 is known as the repayment plan. Within 30 days of filing, you begin court-ordered payments to manage your debt.

You may file Chapter 13 under these circumstances:

  • Your income exceeds the threshold amount set by the government
  • You filed Chapter 7 within the last eight years
  • Your assets exceed state exemptions
  • Your monthly income exceeds your monthly expenses by a prescribed amount

What is a Repayment Plan?

A Chapter 13 repayment plan is a plan to repay some or all of your debt, which is normally over a period of 36 to 60 months. The payment amount depends on the total amount of the debt within the Chapter 13 plan and the amount of the excess of your normal monthly income over your normal monthly expenses. At your 341 hearing, details of the plan are discussed and set in place, to be eventually approved by a judge.

What is a 341 Hearing?

A 341 Hearing (refers to bankruptcy code) is a short, informal meeting of creditors and bankruptcy trustees held 30 to 45 days after you file.

Attendance is mandatory. A member of your legal counsel will accompany you to the bankruptcy court in Toledo.

What Happens if I Miss a Payment?

If you miss a payment, contact us IMMEDIATELY. There are circumstances where payments can be modified or suspended.
